German Court Rules Google May Be Liable for AI Overview Errors

(MENAFN) A German court has ruled that Google can be held responsible for incorrect outputs produced by its AI Overview feature, a decision that could influence how liability for artificial intelligence-generated content is treated in future cases, according to reports.

Google said on Friday that it intends to appeal the ruling.

Traditionally, major tech platforms such as Google, Meta Platforms, and X (social media platform) have argued that they act only as intermediaries hosting or displaying third-party content rather than as publishers, a distinction that limits their legal liability. These companies have also maintained that disclaimers about possible inaccuracies in AI-generated content should protect them from responsibility for errors.

However, the case heard by the Munich Regional Court this spring involved two lawsuits brought by German publishers against Google. The plaintiffs alleged that the company’s AI Overview tool—an automated summary feature introduced last year and displayed above standard search results—produced misleading associations linking their businesses to scams, subscription traps, and illegal activities.

According to the claims, the AI system combined unrelated information from different sources, resulting in false or misleading implications that were not present in the original material.
